This document (as well as any other document mentioned herein), regulates the conditions governing the purchase of products and/or services on this website (hereinafter, Conditions). In addition to reading these Conditions, before accessing, browsing and/or using this Website, it is important that you read the Legal Information, Privacy Policy and Cookies Policy.

1. USER: The contracting of services or products offered by BO SELECTED confers the status of User (hereinafter, User), for which reason at the time at which you wish to proceed to contract services or products (hereinafter, Products) from BO SELECTED, you must expressly accept all the Conditions set forth herein, without prejudice to the application of the corresponding legal regulations applicable to the present case. As a User, you declare that you are over 18 years of age and have the legal capacity to enter into contracts through this Website.
2. PRODUCTS AND/OR SERVICES: BO SELECTED reserves the right to decide which Products are offered to Users through the online store and may add new products and/or remove any of the existing ones at any time and without prior notice.
3. PURCHASE PROCESS: The User can purchase the Website by the means and ways established. Once you have selected all the products you wish to purchase, they will have been added to the basket and the next step will be to make the payment. To do this you must follow the online purchase procedure, filling in and checking the information required at each step. After this, you will receive an email acknowledging receipt of your order (Order Confirmation). The User acknowledges at the time of purchase to be aware of and accept the particular conditions of the product in question.
4. AVAILABILITY: All purchase orders received through the Website are subject to the availability of the Products. If there are difficulties in the supply of the Products, we will contact the User to provide information about substitute Products of equal or superior quality and value for the purpose of modifying the order. If you do not wish to order such substitute Products, we will refund any amount paid.
5. PRICES: The prices displayed on the Website and/or platform used are final, in Euros and include the corresponding taxes. Prices may change at any time, but possible changes will not affect orders or purchases for which the User has already received an Order Confirmation.

   If we discover an error in the price of any of the Products ordered by the User, we will inform the User of the error as soon as possible and give the User the option of reconfirming the order at the correct price or cancelling the order. If we are unable to contact the User, the order will be deemed cancelled and any monies paid will be refunded. We will not be obliged to supply you with any product at the incorrect lower price (even if we have sent you the Order Confirmation) if the pricing error is obvious and unmistakable and could reasonably have been recognized as the incorrect price.

6. PAYMENT METHODS: The accepted payment methods are Paypal and Stripe. The transaction will be made through the User's personal account in that platform, being the only responsible for any problem related to the payment. This method of payment is free of charge for the client. BO SELECTED uses all means to ensure the confidentiality and security of the payment data transmitted by the User during transactions through the Website. The collection, storage and transmission of personal information through the Website is carried out in encrypted form through the use of the SSL (Secure Socket Layer) security protocol, an encryption system which confers total security in the transmission of data.
7. DELIVERY: The delivery time of the order is indicated approximately in the order, and will also be indicated in the e-mail of expedition of the User's order. This delivery time depends on the Products you order.

   For the purposes of these terms and conditions, delivery shall be deemed to have occurred (in the case of digital products), by the User's access to the purchased digital product.

8. WITHDRAWAL: Upon receipt of the order, the User has a period of 14 calendar days to request the exchange or return of one or more Products or to withdraw (freely return) the entire purchase made on the Website. To exercise the right of withdrawal the User must notify its decision, in due time and form, to the email address indicated in the heading. In case of withdrawal the User may also fill out the following form if he/she prefers, and send it to the email address indicated, or in paper format to the address info@bomodels.es. The User may exchange or return any Product purchased on the Website, provided that it is an item subject to the right of withdrawal, as provided below, in its original packaging, unopened (in the case of sealed items) and in perfect condition.

The return policy must be applied according to the product purchased:

• Personalized and/or consumable (and/or downloadable): product due to the passage of time: the right of withdrawal recognized by the regulations of consumers and Users does not apply, the User being aware of this circumstance and accepting it at the time of making the corresponding purchase.
• Erroneous products: returns will be admitted provided that the product is erroneous with respect to the one purchased by the User.
• Products not consumable by the passage of time or customized: the User has a period of 14 days to request the return of the same, taking charge of the cost of return.

Within 14 calendar days after BO SELECTED receives the Product(s) and verifies that they are in good condition, the amount corresponding to the cost of the Product(s) will be reimbursed. The reimbursement to the User will be made by the same method of payment used by the User at the time of making the initial purchase transaction. If the User wants to exchange for another Product of the web, of the same or different characteristics, as an alternative to the refund of the money, a voucher with the balance in your favor will be enabled so that you can place a new order.

9. WARRANTY: All BO SELECTED products are covered by a 2-year warranty against manufacturing defect or non-conformity of the product at the time of delivery. In the event of a manufacturing defect or non-conformity of the product, BO SELECTED shall proceed to replace or repair the product and, if this is not possible, to reduce the price or refund the amount paid. In the case of exchanges and returns, the return costs shall be borne by BO SELECTED. For the exercise of these rights, the provisions of Book Two, Title IV of Royal Legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the General Law for the Defence of Consumers and Users and other Supplementary Laws shall apply.

11. PASSWORDS: BO SELECTED may facilitate the use of personal passwords to the User who registers as such on this web page. The latter must keep the passwords under his or her sole responsibility in the strictest and absolute confidentiality, assuming, therefore, any damages or consequences of any kind arising from the breach or disclosure of the secret. For security reasons, the password for telematic access to the services linked to this web page may be modified at any time by the User.
12. DISCLAIMER: Except as otherwise provided by law, you shall not accept any liability for: (i) losses not attributable to any breach by you; (ii) business losses (including lost profits); (iii) technical failures due to fortuitous or other causes that prevent normal operation of the website through the internet. Unavailability of the website for maintenance or other reasons, which prevents the availability of the service; (iv) any failure or delay in the performance of any of the obligations assumed, when it occurs as a result of consequences beyond its reasonable control, i.e., justified by force majeure.
13. PRIVACY POLICY: BO SELECTED complies with the guidelines of the current regulations on the protection of personal data, the OL 3/2018 of December 5, 2018 on the Protection of Personal Data and guarantee of digital rights and Regulation (EU) 2016/679 of April 27, 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free movement of such data. 14. INTELLECTUAL AND INDUSTRIAL PROPERTY: The contents of the website, including among others the images and texts of the articles, whatever their format, programming language and form of representation, are the property of BO SELECTED, or it has acquired the corresponding rights from their owners, and are protected by the laws and international treaties on intellectual property. Pursuant to the provisions of Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, it is expressly prohibited to copy, reproduce, sell, transmit, distribute, republish, modify or display for commercial use without the prior consent of BO SELECTED. The User undertakes to respect the Intellectual and Industrial Property rights owned by BO SELECTED.
15. COMPLETE AGREEMENT: These conditions and all the documents to which they refer constitute the entire agreement between the User and BO SELECTED, in relation to the object of the sale and purchase and replace any other pact or prior agreement agreed either verbally or in writing between the same parties.
16. MODIFICATION OF THESE TERMS AND CONDITIONS AND DURATION: BO SELECTED may modify at any time the Terms and Conditions set forth herein, which shall be duly published as they appear here. The validity of the aforementioned conditions shall depend on their exposure and they shall remain in force until they are modified by others duly published.
17. SEVERABILITY: If any provision contained in this agreement, or any part thereof, is determined to be invalid and/or unenforceable, it shall not affect the remainder of the provision in question or any other provision contained herein.
18. APPLICABLE LAW AND JURISDICTION: The relationship between BO SELECTED and the User shall be governed by current Spanish legislation and any dispute shall be submitted to the Courts and Tribunals of the city of Barcelona.
